Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the www.fancyboxy.com and www.fancyboxy.co.ke website operated by FancyBoxy Limited ("us", "we", or "our").
Your access to and use of the service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the service.
By accessing or using the service, you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the service.
Liability Limitation
FancyBoxy does not guarantee, represent or warrant that your use of our products will be uninterrupted or error-free, and you agree that from time to time FancyBoxy may remove our products for indefinite periods of time, or cancel the product line at any time, without notice to you.
You expressly agree that your use of, or inability to use our beauty products is at your sole risk. The beauty products delivered to you through our e-commerce website provided ‘as is’ and ‘as available’ for your use, without warranties of any kind, either expressed or implied, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Because some jurisdictions do not allow the exclusion of implied warranties, the exclusion of implied warranties may not apply to you.
Intellectual property
You agree that the products, including but not limited to products or content contain proprietary information and material owned by FancyBoxy and are protected by applicable intellectual property and other laws, included but not limited to copyright. You agree that you will not use such proprietary information or materials in any way whatsoever except for use of FancyBoxy compliance with this agreement.
No portion of these products may be reproduced in any form or by any means, except as expressly permitted in these terms. You agree not to modify, rent, loan, lease, loan, sell, distribute, or create derivative works based on our product design or any manner and you shall not exploit the FancyBoxy products in any unauthorized way whatsoever.
Placing Orders for Goods
You acknowledge that all goods purchased under these terms are intended for personal use only and will not be re-sold. You acknowledge that any FancyBoxy products purchased under these terms are not for resale or for commercial use.
Warranty
FancyBoxy makes no representations whatsoever and gives no guarantees against latent or patent defects in respect of the products, and all conditions and warranties whatsoever, whether implied or otherwise, are hereby expressly excluded.
FancyBoxy shall not incur any liability of whatever nature arising in contract or delict from any injury, loss, or damage to any person or property arising from the use of the products.
The products supplied by FancyBoxy shall be suitable for the purpose designed and intended and the customer shall ensure the products are handled, stored, used, worn or otherwise dealt with in a normal and proper manner, and where applicable, in a manner consistent with the instructions given by FancyBoxy.
No action or claim of whatever nature shall lie against FancyBoxy arising out of or in connection with any defects in, or unsuitability of any products.
User Conduct
In connection with your access to our product offering, you are responsible for compliance with all applicable laws, regulations, and policies of all relevant jurisdiction. Recognizing the global nature of the internet, you agree to comply with all applicable local rules regarding online conduct and acceptable content. Among other things, you agree to not:
- Impersonate any person’s identity
- Bypass any measures FancyBoxy may use to present or restrict access to our service or otherwise attempt (by any means) to gain access to data or information that you are not entitled to access
- Copy, modify, create a derivative of, decompile, or reverse engineer or take any actions to interfere with proprietary and intellectual property rights
- Post, email or otherwise transmit malicious code, files or programs designed to interrupt, damage, destroy or limit the functionality of FancyBoxy’s systems
